When someone likes to cook, bake, experiment with different types of cuisine, and is an avid gourmet, starting a food business is one of the most exciting things they can do. Nevertheless, if they are interested in doing so legally, they will need to conduct in-depth research on the industry trends, marketing strategies, planning and a basic understanding of the legal requirements of the sector to be able to do so.

Food businesses are required to obtain a registration with the Food Safety and Standard Authority of India (FSSAI) by the Ministry of Family Health and Welfare, Government of India, which is the most important requirement of any food business. There is a strong correlation between the safety and standardization of food products manufactured and sold in India and a valid FSSAI food license.

What is an FSSAI license?

A FSSAI was established to monitor and prevent adulteration, unhygienic practices of food processing, improper ingredient collection, and other issues associated with food manufacturing, storage, distribution and sales. By doing so, the FSSAI can prevent and reduce adulteration, unhygienic practices of food processing, and improper ingredient collection, as well as other issues. There are three major categories within it:

  • Small businesses with annual turnovers less than Rs 12 lakh are required to comply with the basics of the FSSAI
  • Restaurants, hotels, and medium-sized food manufacturers with annual sales between Rs 12 lakh and Rs 20 crore in a single state are covered by the state FSSAI.
  • Over Rs. 20 crore turnover enterprises must register with the FSSAI

  2. Regulations, Annexure 2, copies of documents.
  3. Schedule 3 prescribes fees for food businesses, according to their categories.

You must inform the licensing authority in writing if the application requires any additional information or if it appears to be incomplete within 15 days of your submission if the licensing authority requires any additional information. In order to receive a license, the remaining information has to be submitted within 30 days from the intimation. Failure to do so would result in a license application being rejected.

Following receipt of the complete application and additional information (if requested) by the Authority, an Application ID number is assigned. Applicants can expect a license within 60 days after the issue of such an Application ID number, so they can use this ID number for reference and in all future correspondence.

Inspection report

Upon receipt of the application ID, the Licensing Authority may assign an inspector to inspect the business premises to ensure they are in compliance with the law. During the inspection, the Inspecting Officer may give instructions on what steps must be taken or what changes must be made to ensure that the premises remain sanitary and hygienic. The necessary steps and changes must be taken. These changes must be communicated to the authority within 30 days of the change.

Approval of license

When the licensing authority receives the inspection report, excluding the time required to respond to the feedback in the inspection report, it will consider the application and either grant it a license or reject it. An opportunity to be heard will be given to the applicant before the application is refused, and if the authority still decides to reject the application, the reasons for refusal will be given in writing.

Receival of FSSAI license

The licensing authority will issue licenses in Format C under Schedule 2 of the regulations.
