Society Registration

A society is a collection of people who agree to work together for the common good through discussions, regulations, and collaboration. Non-profit organizations (NGO) are societies (Non-Governmental Organizations) created for humanitarian purposes, such as education, the arts, and other forms of culture, rather than for the purpose of generating a financial gain.

The Society Registration Act dates back to 1860. It regulates the registration of organizations in the United States with the purpose of legalizing their operations and ensuring consistency in their governance.

It has been a boon for Society in that state as it provides procedures for society registration and conduct of their activities.

Societies Registration Act – what does it do?

To create standards for organizations’ founding, registration, operations, structuring, and legal status, the Society’s Registration Act (SRA) was passed on May 21, 1860. The Union Territories and States uphold it, making any necessary adjustments to meet their specific needs despite being federal legislation.

The Societies Registration Act facilitates the registration of organizations that benefit society in any sector, from health care to education.

Importance and Benefits of the Societies Registration Act 1860

Recognised societies are legally independent. They are entitled to the following authorities and advantages:

  • When buying a house, fewer legal issues need to be resolved.
  • When a dispute or default is discovered, the right to take legal action is available.
  • Filing tax returns is a legal requirement and a right
  • Getting sued is less likely
  • The transfer of property between entities does not require lengthy paperwork or adherence to tight regulations.
  • In the event that someone attempts to remove your property, you need to defend it against them.
  • Money derived from other sources that is in the possession of the authority.
  • Avoid the hassles of transferring ownership by investing or buying property in the company’s name.

The benefits mentioned above cannot be accessed by societies that aren’t officially recognized. To get official legal status, these organizations must register with the SRA. Therefore, it is highly advised that these organizations register with the SRA.

Types of Societies This Act Can Create

  • The Act’s section 20 permits the registration of societies.
  • Organizations that are non-profit
  • Various Indian presidencies formed funds and organizations to help military orphans
  • A scientific, literary, and fine arts society that transmits information about politics and advances knowledge in those fields
  • Members of the public are welcome to use public libraries and reading rooms as well.
  • In public places such as libraries and museums, there are art galleries.
  • There are many types of art, historical collections, machines, philosophical instruments, and designs.

Entities eligible for society registration

  • Indian and international companies
  • The corporation
  • Those who are not Indian citizens or residents
  • A formal recognition society is one that has been established
  • The age limit is 18, but there is a slight niggle (but not below it)

The Law Governing The Formation of Societies

A venture’s promoter must assist in the formation of a company constituted of venture allottees pursuant to Section (11) (4) (E) of the Real Estate (Regulation and Development) Act, 2016.

A first step in determining the appropriate law will be to determine whether the applicable apartment ownership statute is applicable. The Tamil Nadu Apartment Ownership Act, therefore, applies to structures with three or more floors or five or more flats. A governmental agency must also approve the construction of these structures.

There are several types of welfare or cooperative housing societies that can be formed by owners of residential properties. They may also be formed by owners of unlawful buildings and unregistered housing complexes.

Process for registering a society:

  • Below is the procedure for registering a society
  • Registration of a society is governed by the 1860 Society Registration Act.
  • A minimum of one member is required for incorporation
  • The Society Registration Act 1860 Section 20 defines a society as one in which at least seven members are involved in literature, science, or charitable work.

Memorandum of Understanding

Registrars will register the memorandum once it has been signed by the members of the society.

It is a requirement that the memorandum contain the name of the Society and its goals, as well as the details of its management.

Naming Your Business

Whether it is the Union, the State, the Land Mortgage, the Land Development, the Cooperative, Gandhi Reserve Bank, or any other term that implies or expresses the endorsement, approval, or patronage of the Central or any state government, or that implies the cooperation of the state government where the Society is situated.

There will be no inclusion of the following in the name of the Society: Emblems and names protected by the Emblems and Names Act, 1860.

Here are some points to consider:

  • When naming a society, you should follow the provisions of the Society Act, 1860, which state the Authority will reject a name that is identical to another.
  • Furthermore, neither the state government nor the Indian government should be offended by the name.
  • Names for organizations and companies must comply with the Emblem and Names Act of 1950.
  • The government and community are forbidden from using critical words and phrases.

In accordance with the procedure, the government has imposed strict rules on society registration. According to the Act, a society’s registration should not be void. The establishment of a Society for charitable purposes is encouraged. Laws and regulations regulate everything from its name to prohibitions under which it will not be registered.
