Trademark Registration

A business or other entity can establish ownership of its brand and protect it through trademark registration. The earlier a trademark is registered, the less likely it is that a legal issue will arise in the future. We will talk about the advantages of trademark registration, the necessary paperwork, and electronic trademark filing in this blog.

The advantages of trademark registration are as follows:

You become the registered trademark’s legal owner after trademark registration. Your trademark can’t be used by anyone else without your permission. You cannot sue any other business that has utilized the trademark if you have not registered it.

A good reputation among customers can be built with a trademark. Customers won’t have any trouble finding your product if your trademark is used.

The security of the company’s name and brand is the most significant advantage of trademark registration. And nobody else can use it. A legal action can be taken against those who violate it and use the company’s name.

What documents are needed to register a trademark?

The registration of a trademark requires the following documents:

Proof of Identity and Business: Identity documents like a passport, driving license, or Aadhaar card, among others for the owner of a trademark. In the case of a registered body or legal entity, a partnership deed, incorporation certificate, or registration certificate.

Logo with a slogan: It is necessary to submit a black-and-white logo that includes all of the exact words mentioned in the trademark application. However, a logo is not required if the application is for the registration of a word.

Form 48: Form-48 is used to give permission to an attorney to file the trademark application on behalf of the company.

The acknowledgement of the application is sent to you as soon as you submit the trademark registration form electronically. You are permitted to begin employing the (TM) symbol next to your brand name as soon as the acknowledgement has been received.

After that, your application will be looked at to see if anyone else has the same brand name registered on their name.
